These Terms govern your use of Cher’s Voice across every surface we provide: the responsive web dashboard, the installable Progressive Web App (PWA), and any companion voice features or beta tools (collectively, the “Service”). Cher’s Language Learning Center (“Cher’s LLC,” “we,” “us”) currently offers a freemium model with Basic and Pro subscriptions. By creating an account, installing the PWA, or otherwise using the Service, you agree to these Terms. If you disagree, do not use the Service.
1. License & Ownership
We grant you a limited, non-exclusive, revocable license to use the Service for personal language learning. The software, lesson flows, user interface, audio prompts, and brand assets remain our property. You retain ownership of the content you submit.
2. Installation, Updates & Connectivity
The PWA may cache files for faster loads and limited offline review, but most functionality—AI responses, billing, saved corrections—requires an active internet connection. We may push automatic updates; continuing to use the Service means you agree to run the latest version. You are responsible for device compatibility, OS updates, storage space, and any mobile-data or Wi-Fi charges (including roaming).
3. Acceptable Use
You agree not to reverse engineer, copy, or scrape the Service; bypass rate limits or security; upload malware; infringe intellectual property or privacy rights; harass other learners; impersonate individuals; or use the Service to cheat on exams or credentialing assessments. Do not record or upload another person’s voice without the consent required by your local laws. We may suspend or terminate accounts engaged in abusive or unlawful activity.
4. Accounts & Eligibility
You must be at least 16 years old—or the higher age required by local law—and capable of entering a binding agreement. If you act for an organization, you confirm you have authority to bind it. Keep your credentials confidential and keep your contact, billing, and plan details accurate. You are responsible for all activity conducted through your account.
5. Plans, Trials & Billing
All fees (including Basic and Pro subscriptions) are billed in Gambian dalasi (GMD). Once a payment is processed, it is strictly non-refundable under all circumstances. Cross-currency payments are still settled in GMD, so your bank, card issuer, or mobile wallet handles any conversion and related charges. Subscriptions renew automatically until you cancel in your dashboard or by emailing contact@chersllc.com. A limited no-cost trial may be offered, but once you convert to a paid plan, charges are final.
6. Voice Data, Privacy & Recording
To power speaking drills, we capture audio, generate transcripts, and log acoustic/technical metadata. We process that data through trusted vendors solely to deliver feedback, surface corrections, and improve reliability. We do not use learner conversations to train our own models unless you opt in. Respect all-party consent laws when recording others. Our Privacy Policy explains what we collect, why, how long we keep it, how to request deletion, and how international transfers work. 7. Your Content & AI Output
You retain ownership of the messages, voice notes, uploads, and saved corrections you provide. You grant us a limited license to store, process, and display that content only as needed to operate the Service. AI-generated output may be imperfect, repetitive, or incomplete. It is meant for conversational practice and is not professional, medical, legal, or emergency advice. Use your judgment before relying on AI feedback.
8. Connectivity, Devices & Notifications
Performance may degrade if your device is offline, outdated, low on storage, or low on battery. We are not responsible for failures caused by your connectivity or hardware. We may send transactional notifications (plan changes, billing notices, security alerts) by email, SMS/WhatsApp, or in-app messaging. You can manage non-essential marketing notifications through your settings when available.
9. Changes, Availability & Termination
We may modify, suspend, or discontinue features (including live voice betas, pricing tiers, or topic libraries) at any time. Material changes to these Terms will be announced in the app, via email, or on voice.chersllc.com. Continued use after changes take effect constitutes acceptance. We may suspend or terminate your access for policy violations, security concerns, non-payment, or legal requirements. You may stop using the Service at any time; upon termination you must delete cached files and uninstall the PWA. Data retention follows the Privacy Policy.
10. Disclaimers & Liability Limits
The Service is provided “AS IS” and “AS AVAILABLE.” We make no warranties—express or implied—regarding accuracy, reliability, fitness for a particular purpose, or non-infringement. AI tutors can make mistakes; the Service is not suitable for emergencies. To the fullest extent permitted by Gambian law, Cher’s LLC is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, or data.
11. Governing Law & Contact
These Terms are governed by the laws of The Gambia, subject to any mandatory consumer protections where you reside. Cher’s LLC is not responsible for paying any court fees or court-related costs in the event of a dispute. Disputes will be handled by competent courts in The Gambia unless local law requires another forum.
